If both of you have no property under your name and this is your first matrimonial property (buying under both names), no absd is payable.
Yes, for co-owners you can consider doing a decoupling on your current property to free up one name for the purchase of your second property without paying absd (subject to citizenship).
Unfortunately, we cannot avoid paying ABSD. But, there are methods in which we can take advantage of ABSD to work in our favor. This has benefited many of my clients who have to pay ABSD for their properties.
With the latest regulation introduced on 9th May 2022, any transfers of residential properties into a living trust is subject to an ABSD of 35 per cent. Hence, it is not true and you do have to pay ABSD buying under Trust.
